Subscription and service terms

This is a courtesy translation. The Italian text prevails and Italian law applies.

1. Provider

The Radar Concessioni services (radarconcessioni.com; in English BeachStake, beachstake.com) are provided and invoiced by Bellucci Srl, Via Giacomo Brodolini 4, 47922 Rimini (RN), Italy, VAT 04882010400, PEC [email protected] (hereinafter “the Provider”). Full details in the Legal notice.

2. Subject of the service

Radar Concessioni is an information service that monitors and reworks data from public sources about tenders for state-owned property concessions (maritime, lake, river and thermal) and the related public procedures. The information is informational in nature and does not replace the official tender notice, nor does it constitute legal or administrative advice. The Provider does not guarantee any outcome of the tender procedures.

3. Plans and prices

Prices are in euro and include VAT. Current price list:

The first payment of a Pro plan covers the unlock fee and the first month (€ 348 for one region, € 1,199 for all of Italy); from the second month only the monthly fee is charged. The Provider may change prices for the future; changes do not affect periods already paid and are communicated before renewal.

4. Conclusion of the contract and payments

The contract is concluded on completion of the order and of the payment. Payments are handled by the provider Stripe; the Provider does not store full card details. The invoice is issued by Bellucci Srl.

5. Duration, renewal and cancellation

• The Pro subscription consists of a one-off unlock fee and a monthly fee that renews automatically every month unless cancelled.
• You can cancel at any time, effective from the end of the month already paid: from the reserved area (“Manage subscription” button) or by writing to [email protected] or to the PEC. No minimum term.
• The unlock fee covers the initial setup of the service and is not refundable once provided, save for the consumer's right of withdrawal under art. 7.

6. Personal access, devices and proper use

• Pro access is strictly personal and tied to the email address with which the subscription was activated. Credentials must not be shared with non-subscribed third parties.
• Each account may keep a maximum of 3 active sessions on different devices (for example the office computer, the home computer and the phone). When signing in from a further device beyond the limit, the least recently used session is disconnected automatically.
• Activating many new devices within a short time may be temporarily limited, in order to prevent shared use of the subscription.
• The Provider may adopt technical measures to enforce these limits and, in case of sharing or unauthorised use of the access, suspend or revoke the service without refund, without prejudice to what is already due.
• Data, dossiers and documents obtained from the service are intended for the customer's internal use (assessments, participation in tenders, advice to its own end clients): republication, resale, distribution to third parties and systematic extraction are prohibited, unless authorised in writing by the Provider. The customer remains bound to comply with data protection law for its own uses.

7. Right of withdrawal — consumers

If you purchase as a consumer (outside your business or profession) you have a right of withdrawal within 14 days (arts. 52 ff. Italian Consumer Code, Legislative Decree 206/2005).

As this is digital content/service supplied immediately, at the time of purchase we ask you to consent to the immediate activation of the service and to acknowledge that, once performance has begun, you lose the right of withdrawal (art. 59, para. 1, lett. o) Italian Consumer Code). If you do not give that consent, the service is activated after the 14 days.

8. Business / professional customers

If you purchase in the course of a business, trade or profession (with a VAT number), the consumer's right of withdrawal does not apply and these terms apply with the court of jurisdiction indicated in art. 11.

9. “Eligibility check” and “Dossier” services

These are technical and documentary support activities (requirement checks, preparation of the application and attachments), provided by Bellucci Srl also through partner professionals, on a specific quote. They do not constitute legal advice or representation in the tender, which are reserved to licensed professionals. The Provider does not guarantee the award of the concession.

10. Limitation of liability

The Provider handles the data with diligence but does not guarantee completeness, accuracy or absence of errors, nor the continuity of the service. To the extent permitted by law, the Provider's liability is limited to the amount paid by the customer for the service in the 12 months preceding the event. The mandatory rights of consumers and cases of wilful misconduct or gross negligence remain unaffected.

11. Applicable law and jurisdiction

Italian law applies. For consumers the competent court is that of the consumer's place of residence or domicile. For business customers the court of Rimini (Italy) has exclusive jurisdiction.

12. Changes

The Provider may update these terms; the applicable version is the one in force at the time of purchase. Changes relevant to ongoing subscriptions are communicated before renewal.
